TERMS OF SERVICE

1. THE SERVICE

DMEBcard provides an integrated SaaS platform that combines physical NFC-enabled cards with a digital profile management system.

Digital Subscription: The digital profile is a subscription-based service billed at $15 per month.

Physical Product: The Metal NFC Card is an optional one-time purchase of $99 (plus shipping and applicable taxes).

2. FREE TRIAL & AUTOMATIC RENEWAL (CALIFORNIA COMPLIANCE)

In accordance with California’s Automatic Renewal Law (CARL):

7-Day Free Trial: Your subscription begins with a 7-day free trial. You must provide valid payment information to start the trial.

Automatic Conversion: Unless you cancel at least 24 hours before the end of the 7-day trial, you will be automatically charged $15 for the first month.

Continuous Service: Your subscription will automatically renew every month at the $15 rate until you cancel.

Cancellation: You may cancel at any time via your Personal Dashboard. Cancellation will stop future billings, but no pro-rated refunds are provided for the current billing cycle.

3. PAYMENT PROCESSING (STRIPE)

Third-Party Processor: Payment processing services are provided by Stripe Inc. By using our service, you agree to be bound by the Stripe Services Agreement.

Security: We do not store your credit card numbers or CVV on our servers. All payment data is handled by Stripe’s secure infrastructure.

Authorization: You authorize us (via Stripe) to charge your payment method for all applicable fees.

4. REFUND & RETURN POLICY

Digital Subscription: All subscription fees are non-refundable after the 7-day trial period expires.

Physical Metal Cards (Custom Goods Exception):

Under California Civil Code Section 1723 and U.S. federal consumer law, customized goods are exempt from standard return requirements.

Since each physical card is uniquely encoded and/or printed for the specific User, all sales of physical cards are FINAL.

No Returns or Exchanges: We do not accept returns of physical cards as they cannot be resold or repurposed.

Defects: If a card arrives with a manufacturing defect (e.g., NFC chip failure), you must notify us within 14 days for a replacement.

5. USER CONTENT & RESPONSIBILITY

You are solely responsible for all information (links, photos, contact details) uploaded to your DMEBcard profile. You agree not to use the service for any illegal activities, including impersonation, fraud, or distributing malware.

6. DATA PRIVACY & HOSTING

Hosting: Our system is powered by Base44, with data stored and processed on servers located in the United States.

Compliance: We comply with the California Consumer Privacy Act (CCPA) regarding the collection and use of your personal data.

7. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DME TECHNOLOGIES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE 12 MONTHS PRIOR TO THE CLAIM.

8. GOVERNING LAW & CLASS ACTION WAIVER

Jurisdiction: These terms are governed by the laws of the State of California. Any legal proceedings shall take place in Sacramento County, CA.

Class Action Waiver: You agree to resolve disputes on an individual basis and waive any right to participate in a class-action lawsuit.

9. TERMINATION

We reserve the right to suspend or terminate your account if you violate these terms or engage in conduct that harms our brand or other users.
